Definitions

For the purpose of these terms and conditions,

  • 'Learning Experience' means all learning product types, such as Essential Insights, Introductory Programmes, Accredited Programmes, Development Programmes, Masterclasses, Subscription and Others which may be developed from time to time and are available for purchase online via Our website.
  • 'Subscription term' means the length of time subscription access has been purchased for.
  • 'Instructor-led' means all group-based learning including face to face, a combination of both instructor-led and self-directed learning, and online live-sessions such as Development Programmes, Masterclasses, Face to Face courses, Online classes and Others which may be developed from time to time.
  • 'Self-directed' means learning which You take responsibility for and complete at your own pace online such as Essential Insights, Introductory Programmes, Accredited Programmes and Others which may be developed from time to time.
  • 'Start Date' means the commencement date of the first instructor led Learning Experience session.
  • 'Order date' is the date when access to the hub and self-directed learning was given.
  • 'We' Us' and 'Our' means any member of the “CIPD Group” which consists of The Chartered Institute of Personnel and Development (registered charity in England and Wales (1079797), and in Scotland (SC045154) and incorporated by Royal Charter (RC000758) and its subsidiaries: CIPD Enterprises Ltd, 151 The Broadway, London SW19 1JQ (registered in England and Wales – 02921009); CIPD Asia Ltd, 7 Temasek Boulevard, Singapore 038987 (registered in Singapore 201401681N); CIPD Middle East FZ-LLC, Dubai Knowledge Park, UAE PO Box 503231 (registered in UAE 93098) and CIPD Ireland, A3 The Locks, Charlotte Quay Dock, Dublin 4, Ireland (registered in Ireland 688082). Generally, the relevant member of the CIPD Group that You are contracting with will usually be determined based on where You live i.e. Your geographical location, for example, if You are based in Singapore then the relevant member of the CIPD Group is CIPD Asia Ltd etc.
  • 'You and Your' means the delegate who will be participating in the Learning Experience.

Making your booking

When booking by telephone or online, We will confirm acceptance of Your booking by sending a confirmation to Your nominated email address. Our acceptance of Your booking will give rise to a legally binding contract between Us on these terms and conditions, usually governed by the laws of England & Wales, please see “Governing Law, Jurisdiction and Dispute Resolution” section below for more information.

No amendments to bookings will be valid unless made in writing to eventsregistrar@cipd.asia and confirmed in writing by Us.

Your CIPD Account

All learning is accessed using your CIPD account. By creating an account you confirm you have read, understood and agree to our terms and conditions relating to CIPD accounts.

Transferring your instructor-led booking

You may at any time before Your Start Date notify Us in writing that You wish to defer Your Start Date or transfer to a different Learning Experience. Please note that once a Learning Experience with multiple dates has commenced You must attend each module on the scheduled dates as set out in Your booking confirmation and it is not possible to request any changes.

You are entitled to one deferral or transfer, without fee, if your request is made more than 14 days before your Start date. A second, deferral or transfer request, made more than 14 days before your Start date will attract a fee equivalent to 50% of the course fee.

A third deferral or transfer request made at any time will attract a fee equivalent to 100% of the course fee.

You will pay any increase in the course fee applicable from the date of your request.

The Start Date for any deferral or transfer must be within 12 months of the order date.

All requests made outside the clause above will be treated as a cancellation (see below under “Your rights to cancel”) to which applicable cancellations fees apply.

Transferring your self-directed booking

It is not possible to transfer from self-directed courses once content has been accessed or more than 14 days after your order date.

You will pay any increase in the course fee applicable from the date of your request.

Substitution

Subject to Our approval and at Our discretion, You may nominate a substitute to attend in Your place if You are unable to attend Instructor-led learning for any reason.

Substitution is not possible on self-directed courses once content has been accessed or more than 14 days after your order date.

Your rights to cancel

You may cancel Your booking without charge at any time within 14 days from the order date by emailing eventsregistrar@cipd.asia. This 14-day period is known as the ‘Cancellation Period’.

It is not possible to cancel self-directed courses once content has been accessed or more than 14 days after your order date.

Where the Cancellation Period expires after Your Start Date You will be charged for any services provided to You prior to Your cancellation. Please note that requests to cancel after 14 days of receipt of Your booking confirmation and less than 45 days (for instructor-led bookings) from the Start Date, will be subject to the cancellation fees listed below.

If Your cancellation relates to a Start Date which has been deferred from the date stated on Your booking confirmation pursuant to a transfer request, no further cancellation rights apply.

Payment terms

Payment is required at time of booking and can be made using the payment types offered on the shop.

Free member learning

Free access to certain learning products and member discounts on other learning products are membership benefits. Access to both benefits ends when membership is no longer active. See membership benefits for full details.

Subscriptions

Paid subscribers will be entitled to discounted learning; access to the discount ends when the paid learning subscription expires.

Non-attendance

No refunds are payable if You fail to attend Your Learning Experience.

Online live session materials

We may be able to provide copies of materials such as slide decks or recordings after an online live session on request and where appropriate these materials will be anonymised for confidentiality purposes.

Certification

Accredited Programme Certificates will be issued on successful completion of all assessments for the CIPD Accredited Programme.

Upon successful completion of a Learning Experience an attendance or completion certificate may be issued and available to You as an electronic certificate in Your Learning Hub account.

Period to complete Learning Experience

All Learning Experiences must be completed within the maximum time period stated on Our website, the start date of a Learning Experience being defined as any of the following: induction day, introductory workshop, introductory online classroom, required online and/or telephone activity or the first module that is attended. Completion is defined as completing all Learning Experience requirements outlined on Our website.

Self-directed learning will be accessible for twelve (12) months after the date of purchase unless good reason to terminate access earlier (for example, for misuse or reckless inappropriate use of content) or otherwise stated.

Language requirements

As Our Learning Experiences are delivered in English, it is important that You have achieved a sufficient standard level of English (verbal and written) (IELTS 6.5 or suitable equivalent as a minimum) in order to be able to receive the most learning from Your Learning Experience, and by submitting Your booking You confirm that You have achieved this level of English.

General

We reserve the right to cancel a Learning Experience at any time and offer an alternative date, a credit or a refund without any liability for consequential or indirect loss. All Learning Experience dates are correct at the time of publication. However, alterations may occasionally be necessary due to circumstances beyond Our reasonable control. Personal views and experiences expressed by course and personal tutors and speakers are their own. Course materials are provided for general guidance only and should not be relied on as specific legal or professional advice. Except in the case of death or personal injury arising from Our negligence, we shall not be liable for any special, indirect or consequential loss, or for any economic loss. In addition, Our aggregate liability under this Agreement is limited to the amount of Your booking fees. We accept no liability for any loss suffered by any person acting or refraining from action as a result of the material delivered during or in connection with Our Learning Experiences.

Data Protection

We will use Your personal data for the purpose of delivering the Learning Experience to You. Your name, job title and organisation, as well as Your dietary and learning requirements will be shared with Your trainer and the venue, if the course is delivered face to face, ahead of Your booked Learning Experience. Please note that Your contact details will be used to contact You in relation to Your booking. See Our privacy policy for more information.

Intellectual Property Protection

All content on the Learning Hub belongs to Us and cannot be used without Our permission. Please be aware that You are not allowed to record online classrooms and face to face classroom-based Learning Experiences to protect Our Intellectual Property. For quality assurance purposes only, We may in some instances choose to record any given Learning Experience for internal use only.

You agree to only provide content or information that does not violate the law nor anyone’s rights (including intellectual property rights). You also agree that any information provided will be truthful and accurate. We may be required by law to remove certain information or content in certain countries.

Governing Law, Jurisdiction and Dispute Resolution

In the unlikely event we end up in a legal dispute, You and Us agree to resolve it as follows:
If you live in the United Kingdom (UK) or in a country within the European Union (EU), You and Us agree that the laws of England & Wales govern any dispute or claim and the courts in England & Wales have the exclusive right to hear and decide all disputes and/or claims arising out of or relating to the contract.

If you live outside of the EU (excluding the UK), You and Us agree that any dispute or claim arising out of or in connection with this contract shall be resolved by arbitration with the place (seat) of arbitration the country where You live. The UNCITRAL Arbitration Rules at present in force shall be applied. The number of arbitrators shall be one. If You and Us cannot agree, then the arbitrators shall be appointed by the Chairman of SIAC. The language of the arbitration shall be English, and the law of England and Wales shall govern the arbitration proceedings and subject to the mandatory consumer protections under the law of the country in which You live.
